With the General Data Protection Regulation (GDPR) coming into effect on 25 May 2018, organisations have less than 18 months to develop and update business processes, policies, infrastructure and systems to comply with the GDPR’s requirements. The Regulation introduces a broader set of rights for data subjects (e.g., the right to object, the right to information, etc.), as well as new requirements and obligations for worldwide organisations that collect and process the data of European residents.

Organisations need to be made aware of the GDPR’s implications

Organisations that process the data of EU residents should pay careful attention to the following elements of the new Regulation:

  • Non-compliant organisations can be hit with fines of up to 4% of annual global turnover or €20 million – whichever is higher.
  • Both the supervisory authority and affected data subjects must be notified of data breaches.
  • Data controllers must meet strict requirements for securing the consent of data subjects.
  • Data subjects can bring legal action against organisations following data breaches.
